1. Use of Bino

These Terms apply to Bino Bot, also referred to as Bino, including bino.bot, WhatsApp/search flows, partner/business onboarding, discovery surfaces, APIs, and related services operated by Bohni Tech Private Limited, Bangalore, Karnataka, India.

By accessing or using Bino, you agree to these Terms and our Privacy Policy. You may use Bino only for lawful search, discovery, communication, partner, and business purposes. You are responsible for the accuracy of information you provide and for complying with applicable laws when using Bino.

2. Search and Partner Results

Bino helps users discover, compare, or contact third-party businesses and services. Unless expressly stated otherwise, Bino does not own, create, sell, fulfill, deliver, guarantee, or control partner products or services.

Partner businesses are responsible for their listings, prices, availability, product/service quality, safety, compliance, delivery, cancellation, refunds, customer support, and privacy practices.

3. User Responsibilities

You must verify important information directly with the relevant partner business before making a purchase, booking, payment, or other decision.

You must not submit unlawful, false, abusive, infringing, harmful, or misleading content, or use Bino to violate another person's rights.

4. Partner and Business Responsibilities

Businesses using Bino must provide accurate listings, lawful offers, correct contact details, required licenses/permissions, valid consent or lawful basis for any personal data they submit, and clear customer terms for fulfillment, refunds, cancellation, support, and privacy.

For DPDP-covered data, businesses are responsible for clear notices, valid consent where required, opt-outs, consent withdrawal, customer grievances, correction, erasure, nomination, and any other Data Principal rights where they decide the purpose and means of processing.

5. Privacy and Data Protection

Use of Bino is subject to our Privacy Policy. If Bino processes personal data on behalf of a business customer, the applicable processor terms or written agreement govern that processing.

Unless a separate written DPA, order form, or service schedule says otherwise, these Terms and the applicable baseline processor terms govern Boni's processor obligations for ordinary product use.

You instruct Bino to process submitted data only to provide, secure, support, troubleshoot, improve, and maintain the service; comply with law; prevent misuse; and follow lawful request, partner, support, and deletion instructions.

You authorize Bino to use service providers and subprocessors needed to operate the service, subject to confidentiality, security, deletion, and incident-support obligations appropriate to the service. We may route Data Principal requests or grievances to you when you are the responsible controller/Data Fiduciary, and you must cooperate so they can be handled within applicable timelines.

Businesses must not use Bino to process high-risk, children's, sensitive, or regulated data unless the required safeguards and written approvals are in place.

6. AI and Automation

Bino may use AI-assisted or automated features to understand queries, classify requests, recommend results, or draft responses.

Results may be incomplete, outdated, or inaccurate. You should verify important details directly with the relevant business or provider.

7. Third-Party Services

Bino may depend on messaging platforms, cloud services, AI providers, analytics tools, payment or transaction providers, and partner systems.

Third-party services may have their own terms, fees, limitations, data practices, transfer locations, deletion behavior, and availability constraints.

8. Fees, Referrals, Refunds, and Cancellations

Bino may receive fees, commissions, or referral compensation from partner businesses.

Refunds, cancellations, returns, warranties, and fulfillment issues are governed by the relevant partner business unless a separate written agreement with Bohni Tech Private Limited says otherwise.

9. Intellectual Property

Bino software, interfaces, documentation, designs, logos, and platform materials are owned by or licensed to Bohni Tech Private Limited.

You may not copy, modify, reverse engineer, distribute, or create derivative works except as permitted by law or written agreement.

10. Suspension and Termination

We may suspend or terminate access if you breach these Terms, provide false information, create legal/security risk, misuse the service, violate partner/channel rules, or harm Bino, users, partners, or third parties.

11. Disclaimers and Liability

Except where a separate written agreement says otherwise, Bino is provided on an as-is and as-available basis. We do not guarantee partner listings, prices, availability, quality, delivery, refunds, AI output, or uninterrupted service.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.

12. Governing Law

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka, India will have jurisdiction unless a separate written agreement says otherwise.
